AI Chat 18+ Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and the operator of AI Chat 18+ ("Company," "we," "us," or "our") concerning your access to and use of the AI Chat 18+ iOS application and related services (collectively, the "App" or "Service").

By downloading, accessing, or using AI Chat 18+, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately uninstall the App and discontinue all use of the Service.

2. Age Requirement and Verification

2.1 Age Restriction

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to download, access, or use AI Chat 18+. This is a strictly enforced requirement due to the adult nature of the content.

2.2 Age Affirmation

By using the App, you represent, warrant, and certify that:

• You are at least 18 years of age or older
• You have the legal right to access adult content in your jurisdiction
• You will not permit any person under the age of 18 to access the App
• Accessing adult content is legal in your community and location
• You are not offended by explicit sexual content

2.3 Parental Responsibility

If you are a parent or guardian, you are responsible for monitoring and restricting minors in your household from accessing adult applications. We recommend using device parental controls and age-restriction features available on iOS devices.

3. Nature of the Service

3.1 AI Roleplay Chat

AI Chat 18+ provides AI-powered chatbot characters designed for adult roleplay scenarios, including but not limited to sexual and romantic interactions. All characters and conversations are AI-generated and entirely fictional.

3.2 Fictional Content

You acknowledge and agree that:

• All AI characters are fictional and not based on real individuals
• Conversations are purely fantasy and do not represent real relationships
• The AI has no consciousness, feelings, or genuine emotions
• The Service is for entertainment purposes only
• AI-generated content may be unpredictable and occasionally inconsistent

3.3 No Substitute for Professional Services

AI Chat 18+ is not a substitute for professional therapy, counseling, medical advice, or human relationships. The App is designed solely for adult entertainment and fantasy roleplay. If you are experiencing mental health concerns, relationship issues, or require professional guidance, please consult qualified professionals.

4. Acceptable Use Policy

4.1 Permitted Uses

You may use AI Chat 18+ for:

• Personal, non-commercial adult entertainment
• Consensual fantasy roleplay scenarios with AI characters
• Exploring fictional romantic or sexual scenarios in a private setting

4.2 Prohibited Content and Conduct

You agree that you will NOT use the App to create, request, or engage with content involving:

• Minors: Any content depicting, suggesting, or involving individuals under 18 years of age in any sexual, romantic, or suggestive context whatsoever
• Non-Consent: Scenarios involving rape, sexual assault, or non-consensual acts
• Illegal Activities: Content promoting or depicting illegal acts under U.S. federal law or your local jurisdiction
• Extreme Violence: Graphic violence, gore, or content combining violence with sexual acts
• Bestiality: Sexual content involving animals
• Incest: Sexual content between family members
• Real Persons: Impersonating or roleplaying as real, identifiable individuals without their consent
• Harassment: Using the App to harass, threaten, or harm others
• Illegal Distribution: Sharing, distributing, or publishing content from the App publicly

4.3 Content Monitoring and Enforcement

While we collect minimal user data, we reserve the right to implement automated systems to detect and prevent prohibited content. Violations of this Acceptable Use Policy may result in:

• Immediate termination of your access to the App
• Permanent ban from the Service
• Reporting to appropriate law enforcement authorities when legally required
• Legal action for damages or injunctive relief

4.4 Zero Tolerance Policy

We maintain a zero-tolerance policy for any content involving minors, child sexual abuse material (CSAM), or any illegal sexual content. Any violation will result in immediate account termination and reporting to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement agencies.

5. User Account and License

5.1 Account Creation

Some features of AI Chat 18+ may require account creation. When creating an account, you agree to provide accurate information and maintain the security of your account credentials. You are responsible for all activity occurring under your account.

5.2 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use AI Chat 18+ on iOS devices you own or control, solely for your personal, non-commercial use.

5.3 License Restrictions

You agree NOT to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or redistribute the App
• Remove any proprietary notices or labels
• Use the App for commercial purposes
• Attempt to extract the source code
• Use automated systems, bots, or scripts to access the App
• Interfere with or disrupt the App's functionality

6. In-App Purchases and Subscriptions

6.1 iOS App Store Purchases

AI Chat 18+ may offer in-app purchases and subscription plans through the Apple App Store. All purchases are processed by Apple Inc., and you agree to Apple's terms and conditions for in-app purchases.

6.2 Subscription Terms

If you purchase a subscription:

• Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for unused portions of subscription periods

6.3 Price Changes

We reserve the right to modify subscription prices at any time. Price changes for existing subscribers will be communicated at least 30 days in advance and will take effect at the next renewal period.

6.4 Refund Policy

All purchases are final and non-refundable except as required by applicable law. For refund requests, please contact Apple App Store support directly, as all transactions are processed through Apple.

7. AI-Generated Content and Limitations

7.1 Nature of AI Content

AI Chat 18+ uses artificial intelligence and machine learning models to generate conversational responses. You acknowledge that:

• AI-generated responses may be unpredictable, inconsistent, or unexpected
• The AI may occasionally produce errors or nonsensical content
• We do not guarantee the quality, coherence, or satisfaction with AI responses
• AI content does not represent our views, opinions, or endorsements
• The AI has no actual consciousness, emotions, or awareness

7.2 Content Filtering

While AI Chat 18+ is designed for adult content, we implement safeguards to prevent the generation of illegal content. However, no AI system is perfect. If you encounter content that violates our policies, please report it immediately.

7.3 User Responsibility

You are solely responsible for your interactions with AI characters and any consequences arising from such interactions. We are not liable for any decisions, actions, or emotional responses resulting from AI-generated content.

8. Privacy and Data Collection

Your privacy is important to us. AI Chat 18+ collects minimal data about users. We collect only anonymized analytics and usage statistics that are not linked to individuals or groups—only to the App as a whole.

Important: We do not store, retain, or share your conversation content with AI characters. Your chats remain private and are processed locally on your device or temporarily in memory for generation purposes only.

9. Intellectual Property Rights

9.1 Our Intellectual Property

The App, including all content, features, functionality, software, AI models, character designs, graphics, and user interface, is owned by us and protected by international copyright, trademark, patent, and other intellectual property laws.

9.2 User-Generated Prompts

You retain ownership of your input prompts and conversation inputs. However, by using the Service, you grant us a limited, non-exclusive, royalty-free license to process your inputs for the purpose of generating AI responses and improving the Service.

9.3 AI-Generated Output

AI-generated responses and content created through the App are jointly owned by you and us. You may use AI-generated content for personal, non-commercial purposes only. You may not sell, distribute, or publicly display AI-generated content without our prior written consent.

10. Disclaimers and Warnings

10.1 General Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR SATISFACTORY QUALITY.

10.2 No Guarantees

We do not warrant or guarantee that:

• The App will meet your expectations or requirements
• The App will be uninterrupted, secure, or error-free
• AI responses will be accurate, appropriate, or satisfying
• Defects or errors will be corrected
• The App is free from viruses or harmful components

10.3 Health and Safety Warning

Use of AI Chat 18+ should not interfere with real-world relationships, mental health, or daily functioning. If you find yourself unable to distinguish fantasy from reality, experiencing emotional distress, or developing unhealthy dependency on the App, please discontinue use immediately and seek professional help.

10.4 Addiction Warning

Digital entertainment, including AI chat applications, can become habitual. Please use the App responsibly and maintain a healthy balance with real-world activities and relationships.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, use, goodwill, or other intangible losses
• Emotional distress or psychological harm
• Relationship problems or social consequences
• Offensive, inappropriate, or disturbing AI-generated content
• Unauthorized access or data breaches
• Service interruptions or termination
• Any conduct or content generated by the AI

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use or misuse of the App
• Your violation of any laws or regulations
• Your violation of any rights of third parties
• Your creation or use of prohibited content
• Any false representations regarding your age

13. Termination

13.1 Termination by Us

We reserve the right to suspend or terminate your access to AI Chat 18+ at any time, with or without cause, with or without notice, for any reason including but not limited to:

• Violation of these Terms
• Engagement with prohibited content
• Fraudulent activity or payment issues
• Suspected illegal activity
• At our sole discretion

13.2 Termination by You

You may terminate your use of AI Chat 18+ at any time by deleting the App from your device and cancelling any active subscriptions through your App Store account.

13.3 Effect of Termination

Upon termination, your right to use the App immediately ceases. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability. No refunds will be provided for unused subscription periods.

14. Apple App Store Requirements

14.1 Third-Party Beneficiary

You acknowledge that Apple Inc. is a third-party beneficiary of these Terms, and Apple has the right to enforce these Terms against you as a third-party beneficiary.

14.2 Apple's Role

These Terms are between you and us only, not with Apple. We, not Apple, are solely responsible for AI Chat 18+ and its content. Apple has no obligation to provide maintenance or support services for the App. Apple is not responsible for any product warranties, claims, losses, liabilities, damages, costs, or expenses related to the App.

14.3 Compliance

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

15. Legal Compliance and Jurisdictional Restrictions

15.1 Your Responsibility

You are solely responsible for ensuring that your use of AI Chat 18+ complies with all applicable local, state, national, and international laws and regulations. Some jurisdictions prohibit or restrict adult content, and it is your responsibility to know and follow the laws in your location.

15.2 Restricted Jurisdictions

If adult content is illegal in your jurisdiction, you must not access or use AI Chat 18+. We are not responsible for violations of local laws by users who access the App from restricted jurisdictions.

15.3 Export Compliance

The App may be subject to U.S. export control laws. You agree not to export, re-export, or transfer the App to any prohibited country or person in violation of U.S. or other applicable export control laws.

16. Dispute Resolution and Arbitration

16.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us at team@aichatapps.co to attempt to resolve the matter informally. We will work in good faith to resolve disputes.

16.2 Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the App that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.

16.3 Class Action Waiver

YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN YOU AND US INDIVIDUALLY. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

16.4 Jury Trial Waiver

YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO HAVE ANY DISPUTE RESOLVED IN COURT.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware and the United States of America, without regard to conflict of law principles. Any arbitration shall take place in Delaware.

18. Changes to Terms

We reserve the right to modify these Terms at any time at our sole discretion. If we make material changes, we will provide notice through the App or by other reasonable means at least 30 days before the changes take effect.

Your continued use of AI Chat 18+ after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the App.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding AI Chat 18+ and supersede all prior agreements, understandings, and communications, whether written or oral.
